24.09.19 - In the end, everyone was in agreement and the Public Prosecutor's Office in Hamm has also requested that the extradition of the persecuted person to Romania for execution of sentence be declared inadmissible on the basis of a European arrest warrant. Although the Romanian authorities had given assurances to our client regarding the conditions of detention there, these were far from sufficient (OLG Hamm III-2 Ausl 152/19). A personal detention area of 2 m² does not meet the requirements of the European Court of Human Rights. It is astonishing that Romania still sends extradition requests to Germany with such assurances.
