Extradition to Romania was declared admissible
Hamburg - 03.01.2017 - The Higher Regional Court Hamburg (decision of 03.01.2017 - Ausl 81/16) has declared an extradition to Romania admissible despite the widely known disastrous conditions of prisons in that country.
The Higher Regional Court Hamburg said, there would be no obstacle against extradition, in any case, with regard to the conditions of detention in Romania, even in the light of the guarantees of § 73 I, II IRG, Article 4 of the EU Charter of Fundamental Rights. The Higher Regional Court of Hamburg cites the European Court of Human Rights's and draws on a report on improvements in the Romanian prison system.
