The Higher Regional Court of Bremen (21.09.2018 - 1 AuslA 21/179) has declared the extradition of a persecuted person to the Republic of Hungary for the execution of the prison sentence of one year and eight months admissible, after examination of the Hungarian prison conditions.
The Bremen Higher Regional Court recognised general systemic deficiencies in the conditions of detention in Hungary, and requested further information on the impending conditions of detention prior to extradition to Hungary in the extradition warrant of 19 December 2017 and referred the case to the European Court of Justice by order of 27 March 2018, which announced its decision on the required scope of the examination on 25 July 2018 (see ECJ, Judgment of 25 July 2018, ML - C-220/18 PPU, OJ EU 2018, No C 328, 23).
The Higher Regional Court of Bremen (21.09.2018 - 1 AuslA 21/179) decided that it had received sufficient information from Hungary in the meantime to exclude the risk of inhuman or degrading treatment of the persecuted person after his surrender to the Republic of Hungary.
