Extradition to Hungary can take place on the basis of a European arrest warrant. Germany and Hungary have extradition traffic in both directions. German citizens can also be extradited to Hungary on the basis of a European arrest warrant for criminal prosecution - not for execution.
Hungary is a member of Interpol. The European arrest warrant is transmitted directly between the competent judicial authorities of both countries.
A European arrest warrant may only be issued after an indictment has been filed if the prosecutor has made a formal request in the indictment for the imposition of a custodial sentence. Under Hungarian law, the arrest warrant can only be appealed if the defendant has actually been arrested.
In Hungary, sentences in absentia are possible against accused persons who are unknown residents and who are expected to be sentenced to imprisonment. The person sentenced in absentia may demand that the proceedings be resumed, but this must be verified in the specific case.
