Bosnia and Herzegovina has considerable extradition statistics, in recent years at least 5-10 or more extradition requests have always been received from there in Germany. Extradition from Germany to Bosnia and Herzegovina is possible in principle; its admissibility is governed by the European Convention on Extradition of 13 December 1957. Extradition on the grounds of fiscal criminal matters is also possible.
However, extradition of German citizens to Bosnia and Herzegovina does not take place; the German Basic Law protects against this (Article 16 of the Basic Law). Provisional arrest for extradition - on the basis of a mere Interpol search - can be ordered in Germany against foreigners if extradition to Bosnia and Herzegovina is not excluded from the outset in individual cases.
In 2016, the German Federal Constitutional Court dealt with extradition to Bosnia and Herzegovina, in particular with the substantiation requirements for an obstacle to extradition alleged by the persecuted person.
